Terms and Conditions

Please read these Terms and Conditions (“T&C” “Terms”) carefully as they affect your rights and liabilities under the law. These Terms do not violate your statutory rights as outlined in the Consumer Rights Act 2015 ( http://www.legislation.gov.uk/ukpga/2015/15/contents/enacted ) By placing an order with TKJ Holding Limited trading as Melos - on the www.melos-mart.co.uk website (“Website” “Melo's” “Our” “Us” “We”) you explicitly and implicitly agree to be bound by the T&C listed below which apply to any purchase made from Melo's. If you do not wish to be so bound, please do not use or access our Website and services.

 

1. AMENDMENT OF THE TERMS

1.1 These Terms are subject to change at our discretion from time to time. It is the consumer responsibility to read and agree with the up to date Terms. If you do not wish to accept the new T&C, you should discontinue the use of the Website and services. If, after amendments have been made to this Contract, the consumer continues to use Melos, it indicates your agreement with the New T&C.

 

2. PURCHASE CONTRACT

2.1 All purchases made on this web site are governed by these T&C at any time although the T&C governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date and time when these Terms and Conditions were most recently updated.

 

3. ORDERING

3.1 We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.

3.2 There is no minimum spend but delivery charge for all orders.

  • Delivery Charge is £6.95, however, depending on the order amount and location delivery is free as below
    • Liverpool orders above £25 will be FREE delivery
    • For orders Outside Liverpool and over £50 will be FREE delivery

 3.3 Stock levels displayed are to be considered as a guide only. While every care is taken for the availability of a product to be correctly displayed, availability of stock can only be confirmed upon the preparation of the order.

3.4 You must be 18 years old or over and must have completed the registration process in order to participate in our service.

 

 

4. AVAILABILITY OF THE WEBSITE

4.1 Although we aim to offer you the best service possible, no promise can be made that the services offered will meet your requirements. TKJ Holding Ltd cannot guarantee that the service will be without fault, however the Company will remedy any issue as detailed in this T&C. If an issue occurs, you should report it to us within the timeline reported in these T&C in accordance with the Consumer Right Act and on Online purchases.

4.2 Access to the Website may be occasionally restricted to allow for repairs, updates, or maintenance. We will attempt to restore the service as soon as it reasonably can.

 

5. LIMITATION OF LIABILITY

5.1 To the full extent permitted by the applicable law, by purchasing on Melos you agree that we will not be liable to you or any third party for any incidental or consequential damages, or any other indirect, special or punitive damages that arise out of or are related to the Website.

5.2 Any liability arising out of any order or supply of goods will be limited to the retail price of the goods contained in the particular order.

5.3 Melos and its content is provided without warranties nor guarantees. You are the sole responsible for any risk incurred associated with the use of the Internet.

 

 6. PRODUCT REPRESENTATION

6.1 All pictures shown are for illustrative purposes only. The packages and labels of the Products may vary.

6.2 We will not consider a product to be ‘not as described’ based on different interpretations of the products’ name and description.

 

7. DELIVERY

7.1 Melos delivers to the UK.

7.2 Deliveries are made either using our vans or using a third party delivery Company. We reserve the right to restrict delivery in certain areas and this includes the right to eliminate any area from our delivery schedule altogether

7.3 Categories of Liverpool Only will be delivered with our own vans. Should you require these restricted items, you need to contact us, and bear the full responsibility for any product damage and monetary loss.

7.4 Yourself or an authorised person must be present to accept the delivery. However where the customer requests for us, or for us to instruct the courier, to leave the parcel in a specific location, we will comply. In these circumstances we will not accept claims of non-delivery, as the delivery will be considered completed either by our own drivers, or the courier Company.

7.5 Should you fail to be present for the delivery and your order contains Fresh Meats and Fish, Frozen or Fruit and Veg, we are entitled to charge you for an amount equal to the total of the perishable items contained in your order.

 

8. AMENDMENT OF ORDERS CANCELLATION

8.1 You can add or remove items, change the address, add delivery instructions, or cancel your order by sending an email to us stating the order number.

8.2 Any amendments or cancellation must be requested in accordance with our cut off times:

  • Orders in Liverpool, by 3pm on the day of delivery

  • Orders outside Liverpool: by 1pm the day before the parcel collection from the courier company. 

8.3 After delivery it is your statutory right to cancel the order in full or in part within 14 days of the receipt of the goods. If the cancellation reason is outside of the terms defined in this T&C agreement, you will be responsible for the cost of the returning the goods to us and for any damage incurred to the goods before reaching us.

 

9. RETURNS/REFUND

9.1 You have the right to return or ask for a refund of any non-perishable items within 14 days of receipt of the order.

9.2 If you discover that there's something wrong with the product, such as a fault, damage or it's not as described as per the T&C defined in this agreement, you can request a refund by sending an email to info@melos-mart.co.uk

9.3 At our discretion we will reserve the right to ask for an item to be returned to us at your expense or to collect the item ourselves. Please do not dispose of the product before contacting us.

9.4 When you request a refund or a return of an item, we require a photo of the product as received and we reserve the right to deny the refund if it is found that we are not liable for the cost of the item as specified in this T&C agreement. Items must be returned intact and in original condition and packaging.

9.5 In the case of loss or damage of an order or a product, we will issue a refund or a voucher for a maximum amount of the damaged item and the delivery fee of that order.

9.6 If you, or a representative is not home to receive the delivery, we will reschedule to attempt the delivery a second time within the next day. You are responsible to bear the cost of any perishable items to be replaced should you miss the delivery a second time, or fail to provide an alternative delivery date within 24hrs of the missed delivery.

9.7 If the address selected is incorrect or incomplete, you need to notify us as soon as possible. If the order has already been shipped and there is a change in Delivery area, you are responsible for any additional delivery charges that may incur. In this event, we reserve the right to change the delivery date and/or time-slot.

 

10. PAYMENT

10.1 It is your responsibility to use a valid method of payment and pay the goods ordered in full and on time.

10.2 Payment is processed at the moment of ordering, when you pay by card.

10.3 When you add items to your order, you are authorising us to proceed with the payment for a maximum of the sum of the retail price of the items added. If payment cannot be processed we will offer alternative payment methods. It is your responsibility to ensure the additional payment can be processed.

10.4 Payment information is handled by a third party Company and is not stored by us. The third party can be changed by us at any time.

 

11. COMPLAINTS

11.1 Any complaints regarding the service offered on the Website will be assessed by our Customer Service. You can find the details on how to reach us on the ‘Contact Us’ page in the Website.

11.2 Complaints must be received within 14 days from the date of receipt of the order. We are not liable for any issues presented to us after this deadline.

 

12. PRIVACY

12.1 To order on Melos we will require certain personal information necessary to process payment and to deliver the goods and services. We are committed to your privacy and we do not share, sell, or abuse your data.

12.2 The data necessary to efficiently process your order may include:

  • Your name

  • Name of the person receiving the order, if different from the person ordering

  • Billing address

  • Delivery Address

  • Payment information

  • Email Address

  • Your phone number

  • The number of the person receiving the order, if different from the person ordering

12.3 Unless you specifically authorise us, we will not use your email address for marketing purposes. You can subscribe and unsubscribe from our Newsletter through your account on the Website at any time.

12.4 As part of the shipping process it may be necessary to share some of your personal data with the courier company. These information is limited to:

  • Name of the person receiving the order, if different from the person ordering

  • Delivery Address

  • Email Address

  • The number of the person receiving the order, if different from the person ordering

12.5 Data is usually stored on systems indefinitely. It is your right to request of us any data we hold about you, to have any data removed permanently. To do so please send an email to our Customer Service.

12.6 Melos uses cookies in order to enhance the user experience, for example saving the items in your cart. You can delete the cookies from the privacy settings of your browser.
